Washington, D.C. - U.S. Congressman Matt Gaetz (FL-01) has raised concerns about the Environmental Protection Agency's (EPA) recent ruling on Berkey Water Systems, classifying their gravity-fed mechanical water filters as pesticides. In a letter addressed to EPA Administrator Michael Regan, Rep. Gaetz highlighted the agency's attempt to potentially put Berkey out of business.

The EPA's classification stems from the incorporation of silver in Berkey's filters, which the agency argues falls under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). As a result, Berkey will now be required to label its products with aggressive warnings. Rep. Gaetz, however, questions the EPA's decision, stating that millions of water filters also incorporate silver and should not be treated as pesticides.

In his letter, Rep. Gaetz emphasized the unjust nature of the EPA's actions, stating, "This unprecedented attempt to, arbitrarily and without administrative process, put Berkey Water Systems out of business is an abuse of the EPA's regulatory authority." He further argued that the EPA should be focusing on policies that promote the use of water-filtration systems, particularly in light of the increasing health concerns and water contaminants faced by Americans.

Rep. Gaetz called for answers from the EPA, seeking clarification on several key points. Firstly, he questioned why the EPA has suddenly decided to change its regulations regarding Berkey Water Systems after decades. Additionally, he requested copies of any policy documents, guidance, or regulations that formed the basis of the EPA's actions against Berkey Water Systems since January 1, 2022.

Furthermore, Rep. Gaetz sought clarification on whether the EPA considers the incorporation of silver or other metals into non-operable, incidental, or cosmetic features of a consumer good as grounds for classifying it as a pesticide under FIFRA. He also inquired about the standard for incorporating metals into product design that qualifies a product as a pesticide and whether this standard has gone through the appropriate rulemaking process.

The Congressman concluded his letter by urging the EPA to cease its attack on Berkey Water Systems and refocus on its core mission of ensuring the safety of Americans. He believes that Berkey Water Systems has played a significant role in providing safe drinking water to millions of Americans and should not be hindered by unwarranted regulatory actions.

It remains to be seen how the EPA will respond to Rep. Gaetz's letter and whether any changes will be made to their classification of Berkey's gravity-fed mechanical water filters. As the debate unfolds, the implications for the water filtration industry and the broader issue of water safety will be closely watched.
