Congressman Gaetz Blasts Biden Admin’s Monitoring of Illegal Aliens Following Virginia Officer’s Near Death

Washington, D.C. — On September 11, 2023, U.S. Congressman Matt Gaetz (FL-01) sent a letter to Department of Homeland Security (DHS) Secretary Alejandro Mayorkas regarding the Biden Administration’s negligent monitoring of illegal aliens in the United States following the near death of a Virginia police officer.

On August 19th, 2023, an illegal alien known by DHS, Yacarely Diaz-Castro, was driving intoxicated and crashed into a police officer conducting a traffic stop in Chesapeake, Virginia, sending the officer over the guardrail and causing critical injuries to his body. Ms. Diaz-Castro entered the United States illegally seven months ago and allegedly claims to have received a “Notice to Report” Form I-385. Rep. Gaetz’s letter highlights the abject failure of the Biden Administration’s ability to follow through with the removal of illegal aliens and requests specific answers regarding DHS’s knowledge of Ms. Diaz-Castro be provided to his office by October 2nd, 2023.

LETTER TEXT

Dear Secretary Mayorkas:

On August 19, 2023, around 2:30 a.m. in Chesapeake, Virginia, illegal alien Yacarely Diaz-Castro ran her vehicle into a Chesapeake police officer conducting a traffic stop, sending the officer flying over a guardrail. Officers found empty beer cans in her vehicle, and she failed multiple sobriety tests and reeked of alcohol. She had no driver’s license. The injured officer suffered a fractured skull, a C6 vertebrae fracture, and potentially a lifetime of physical impairment. 

Diaz-Castro was known to your Department. She is from Nicaragua and entered the United States illegally seven months ago, and she allegedly claims to have received a “Notice to Report” Form I-385. This document, while itself an unlawful papering over of your open-border policies, does mandate a recipient report to Immigration and Customs Enforcement (ICE) within 60 days, at which point the illegal alien should begin removal proceedings by receiving a “Notice to Appear.”

Please reply to my office by October 2, 2023, with the following information:

  1. What was the immigration status of Yacarely Diaz-Castro on August 18, 2023?
  2. When, to the best of your Department’s knowledge, did Diaz-Castro unlawfully enter the United States?
  3. Did Diaz-Castro receive any “Notice to Report” from your Department or any subcomponent thereof? If so, please provide a copy.
  4. Did Diaz-Castro report to ICE at any point? If so, when?
  5. How many illegal aliens, like Diaz-Castro, have failed to comply with their Notices to Report?
  6. What steps is your Department taking to ensure swift removal of illegal aliens who fail to comply with their Notices to Report?
  7. How many law enforcement and first responders have been injured by illegal aliens like Diaz-Castro in the past two years?
